Thousands of
people are hurt each year by defective or dangerous
products. The law of products liability is different then
that of negligence. When a consumer purchases a
product a contract is formed between the consumer and the
manufacture of the product.
If the product is found to be
defective then the manufacture could be in breach of
warranty. An implied warranty is a warranty that
is implied by Texas law when goods are sold. Under Texas' law
of implied warranty, all goods that are sold must generally be
fit for their intended purpose. If a product is not generally fit for
its intended purpose, or if it does not meet the terms of its
express warranty, a person injured by the product may sue the
manufacturer for breach of warranty.
